The Reminder of License Versus Ownership

An interesting conversation took place today. The discussion centered around copyright, inventions and patents. The reality of the world around us has nearly completely detached itself from the ideas and laws around the ideas of property and intellectual rights.

We spoke about developing software and if that software is then copyrighted, would that also hinder the type of code or chunks of code that were used in the various functions of the application. It quickly became apparent that it would be very hard to enforce a copyright on the individual pieces of code that make up an application.

It then became a "a ha" moment to understand why software usually comes with an End-User License Agreement or EULA. When you purchase a copy of a software application, you’re not actually purchasing the software itself or the code that makes up the software program.

What you’ve purchased and agreed to is a license to use the software and take advantage of the functionality that the software provides to you.

The difference between open source code and "closed" code is that you don’t get to mess with the "closed" code, because that’s the value of what you just bought. You’re just borrowing the opportunity to use the version you paid for as long as you can.

Conan More Supported Than Leno

This late night war is starting to get absolutely ridiculous.  In case you don't know what's going on, after Jay Leno left the Tonight Show, Conan O'Brien took over.  It was a transition that had been in the works for years but just before the switch, rumors started circulating about Leno not wanting to relinquish his seat.

Now, it's been less than a year and NBC is making a huge mess of things.  They've canceled the variety show they had given Leno and now they want him to have some crappy half hour show at 11:35pm which would bump Conan to 12:05am.  I'm not even going to comment on what this is going to do to Jimmy Fallon and Carson Daly, who come on after Conan.

There has been a lot of support for Conan, ranging from his fellow late night hosts including David Letterman, to the fans.  A poll on TVGuide.com shows that 83% of viewers feel that Conan should remain in the 11:35pm time slot.

I am a long time fan of Conan's brand of comedy and I really think it's petty and ridiculous that Jay Leno is being coddled like this.  His time is up, he chose to retire and he should have to live with his decision.

“Modern Warfare 2” Passes $1 Million Mark

Call of Duty: Modern Warfare 2 has made over $1 million since being released last November which, I'm sure, is making Activision Blizzard very happy.  If this keeps up, it will become the best selling game of all time.

Currently, Grand Theft Auto: San Andreas holds the record at 23 million copies sold after being released in 2004 but Call of Duty: Modern Warfare 2 has moved 17 million copies in just a couple months.

I am not surprised by this at all.  This game really is good and I know a lot of people liked the first Modern Warfare but would have preferred to not have it set in Iraq.  It's just too political and, I don't know about you, but I want to escape from the stress of real life when I play.  Having this be a little more fictional made it a lot more enjoyable for me and I guess others felt the same way.

Michael McDowell has signed with McDonald Motorsports

NASCAR’s Nationwide Series veteran MacDonald Motorsports has signed a deal with Michael McDowell that will see the driver sitting behind the wheel of the No. 81 Dodge for the Nationwide Series season.

This is a great opportunity for McDowell and the team to work together toward a goal both have been seeking for a few years. McDowell had a pretty good showing in during the 2009 Nationwide Series season, with a 13th place finish. McDowell will be joining a revamped MacDonald Motorsports, with new cars, garage and crew chief.

McDowell comes from the Phoenix area and has driven race cars in all three of NASCAR’s top divisions. He hasn’t had the best results of yet, with just five Nationwide Series top five finishes on his record. McDowell will be working with a crew chief he has worked with before, Patrick Donahue, as he gets behind the wheel of the No 81 Dodge.

The financial situation in NASCAR means that smaller teams can often be even more competitive against the larger firms. McDonald Motorsports has moved to a new location in Mooresville, bought new equipment and are making the committment they need to make to have a chance to achieve some good results on the Nationwide Series in 2010.

They seem to be headed in the right direction as they turn the team down the road leading to another season, but then you never know what’s going to happen. Once the season gets under way well get to see some amazing racing and be entertained week after week, but other than that, your guess is as good as mine as to what’s going to happen.

Dexter’s Michael C. Hall Has Lymphoma

Many people are watching former Survivor winner Ethan Zohn’s battle with a rare type of Hodgkin’s lymphoma. Sadly, although he was cancer-free after intensive therapy, the cancer has returned and he is battling it yet again (Ethan Zohn: ‘My Cancer Is Back‘). With luck and a lot of hard work, he may beat it yet.

34828PCN_HallNow comes news that another personality, this time Dexter’s Michael C. Hall, is also battling Hodgin’s lymphoma. From the news reports where it says his lymphoma is treatable and curable, it sounds like it’s not the same type that Zohn has, but it is frightening nonetheless.

According to the United States National Cancer Institute, there were 8,510 new cases of Hodgkin’s lymphoma in the U.S. in 2009 and there were 1,290 deaths.

Lymphoma is cancer of the lymphatic system, which is part of the immune system. The lymph is a clear fluid that circulates through vessels go throughout the body, passing through lymph nodes, which are like filters.

Unlike solid cancers, there is no tumor to cut out, so treatment is chemotherapy and/or radiation therapy, with the goal of destroying the cancer cells.

Hodgkin’s lymphoma used to be very difficult  to treat but with the advances in medicine has made it highly treatable.

Winter Woes: Back Injuries and Pain Tips

The Winter Olympics events are less than a month away. We’ve been hearing stories of athletes, who have been training for years, going down with injuries over the past few weeks, destroying their 2010 Olympic dreams. But athletes aren’t the only people who get hurt in the winter.

snowPeople who live in climates that include winter weather know that it’s easy to get hurt if you’re not careful. And, with parts of the world that aren’t usually exposed to winter weather, more people may be susceptible than ever before. Whether you’ve shoveled snow every year of your life or you’re shoveling it for the first time, if you’ve sledded down thousands of hills or you’re taking your child sledding for the first time,  there are things you need to know and do to prevent a back injury that could end up following you for life. In fact, did you know that the vast majority, up to 80%, of adults, will experience at least one episode of back pain within their lifetime?

80% of adults are estimated to have a back injury at some point in their life and with winter in full force, back injuries are even more common. Snow shoveling, slippery ice and winter sports such as sledding, skiing and snowboarding are just some of the culprits of winter back injuries. ChicagoHealers.com Practitioner Dr. Mark Sobor specializes in pain management and offers suggestions to people who may hurt their back slipping on the ice, shoveling or taking advantage of winter fun:

See Your Doctor

While this may seem obvious, it’s quite surprising how many people don’t get their back pain checked. Unfortunately, if the injury is more severe than you realize, not seeing a doctor and doing self-treatment may end up with you experiencing much more severe pain and disability.

If you:

  • Have pain shooting down one or both legs
  • Feel your legs are weak
  • Cannot control urination or moving your bowels
  • Find your pain is not relieved by medication

Resting

It used to be that bedrest was recommended for back injuries. Doctors now know better and only recommend that you rest for only two or three days, to allow your muscles to relax. Unless your medical history doesn’t allow for it, you may be able to take anti-inflammatories, like ibuprofen, to help relieve the back pain. Dr. Sobor also suggests that you lay on a hard surface, flat on your back, with a pillow beneath your knees. Laying in a fetal position, on your side, is also fine. He also recommends these exercises when the pain is not as great:

  • Lay flat on your back on a hard surface
  • Pull knee to the chest, one leg at a time, hold for several seconds, release
  • Repeat 5-10 times for each leg
  • If you can pull both knees to the chest at the same time without pain, perform that 5-10 times also.

As well:

  • Stretch and strengthen all muscles and joints in order to help relieve back pain.  In addition to doing exercises stretching hamstrings, neck, shoulders and spine every day, one should routinely do other low-impact exercises such as:
    • Walking
    • Pilates, which strengthens core muscles
    • Yoga
    • Swimming
    • Low impact aerobics
    • Riding a stationary bike or using an elliptical trainer

Salt, as in almost everything else, is good in moderation. In fact, our body needs salt for it to function properly. But, if you consume too much salt, you’re setting yourself up for a host of health problems. Despite knowing this for the past few decades, salt consumption still remains high in some populations.

saltResearchers in Sweden discovered that young Swedish men are among those who consume too much salt for their own good – almost double the recommended daily allowance. Their findings were published in the journal, Public Health Nutrition.

Researchers analyzed the urine of almost 100 men who were in their twenties. The researchers were looking at how much salt was being excreted by the kidneys. The men detailed what they ate and their salt use. What the researchers found was that although the World Health Organization (WHO) recommends that healthy adult men not consume more than 6 grams of salt every day, the men in the study were consuming at least 12 grams per day.

The concern with young adults eating too much salt is not the short-term consequences, but the long-term ones. While young, the body may be able to cope with filtering out the excess salt, but as the kidneys begin – and continue – to work too hard, they can begin to fail and cause other health issues, some of which can be very serious.

It’s particularly important for people to be aware of what the salt content is of the food they are eating because if they regularly, even unconsciously, add salt to their foods, they are increasing their salt intake.

Reading and comparing labels can help you reduce the salt intake of prepared foods. When cooking, if you experiment with flavorings from herbs and spices, you may find you don’t need as much salt for your creations.

Hamster Video Game…Err…Video

Yeah. I know. This isn’t exactly about video games. Well…it kinda is.Hamster-Game-Pwning-Noobs

I mean it has the “old school” video game music. That makes it about video games.

Right?

And then there’s the 8-bit gaming environment…if you ignore the fact that there’s a HAMSTER wandering around.

My absolute favorite part is 1:28 when the hamster is all like, “WTF?! WHERE AM I GOING!?!”.

But maybe that’s just me.

And I’ll tell ya, I had no intention of watching the whole thing. In fact, I didn’t even mean to start watching the damn video but there was just something about that little innocent hamster’s quest that held me like I had a collar around my neck and the hamster had the leash.

Just me?

Damn.

Regardless, watch the video and be amazed at the great leap of technology. Be amazed.

Fitness Tips for Keeping the Weight Off

Congratulations on losing that 20 lbs you’ve wanted to lose, but the game isn’t over.  Now that you’ve lost 20 lbs, you need to keep the weight off.  Of course your eating habits dictate a large portion of that success, but let’s not forget exercise’s ability to cover up your indulgences that prevents calories from stacking on your fat storage.

Keep these exercises mixed in your weekly rotation and you’ll go miles towards maintaining that great body.

  1. 10 minutes of abs.  Ab exercises are actually decent cardio if you go deep enough into your routine.  Plus, you’ll strengthen your core, thereby giving you more muscle and more calorie burning ability.  Go for 4 times a week.
  2. 20 minutes of stair stepper.  The stair stepper can be a huge challenge if you push yourself on the programming.  Keep the intensity high and the sweat will be rolling off you by the time you quit.  Tones your legs and burns the fat.  What more can you ask for?  Try 3 times a week.
  3. 20 minutes of treadmill.  More huge benefits when you challenge yourself on the treadmill.  Try incline and interval training with the treadmill.  Also, it’s ok to start off with a brisk walk to get the blood flowing and then progress to a more challenging pace or grade.  Aim for 2-3 times a week.
  4. 30 minutes of weight lifting.  Remember, muscle burns calories and a lean muscular body will have you burning calories in your sleep.  Resistance train at a quick pace and you’ll accomplish even more.  3 times a week will suit you well.
